OVWG – Invitation to the 4th OVWG expert panel on 23 November 2020 (online)

The OVWG has argued for years that Austrian gambling regulation is contrary to EU law and that the online sector in particular requires new regulation. Now, a current expert opinion from the University of Osnabrück dated 7 September 2020 is available, which shares the legal opinion of the OVWG and once again confirms the illegality of the Austrian gambling regulation.

According to the study, the following facts, among others, lead to the incoherence and thus to the illegality of the Austrian regulation under Union law:

  1. The limitation to one online licence.
  2. The installation of video lottery terminals, especially in those federal states where automated gaming is otherwise prohibited.
  3. The fact that poker may now only be offered in casinos.
  4. The three additional (not advertised) casino licences.

In our next expert panel on 23 November 2020, the authors of the expert opinion, Univ.-Prof. Dr. Bernd Hartmann, LL.M. (University of Osnabrück) and Univ.-Prof. Dr. Tristan Barczak, LL.M. (University of Passau) will present the main findings of their expert opinion and explain in detail why the Austrian gambling monopoly is illegal under EU law. There will then be an opportunity for questions and discussion with the authors of the study. Due to the COVID-19 situation, the expert panel will take place online for the first time.
